Offences and penalties
It is an offence under the Independent Commissioner Against Corruption Act 2012 (the ICAC Act) to prevent a person from making a complaint or report.
It is also an offence to make a false or misleading statement in a complaint or report. Those offences are punishable by a maximum penalty of $10,000 or imprisonment for two years.
It is also an offence under section 56 of the ICAC Act to publish or cause to be published certain types of information that may put confidentiality at risk, including information tending to suggest that a person is, has been, may be, or may have been the subject of a complaint or report.
